PREVENT, REDUCE, MITIGATE or MINIMIZE ENVIRONMENTAL CONCERNS Many facilities may be required or recommended to have in place such plans and documents as Storm Water Pollution Prevention Plans, Spill Prevention, Control and Countermeasure (SPCC) Plans, Best Management Practices, Tier II Reporting, state or local permits, and others as appropriate for the facility, industry, activities or aboveground or underground storage tanks or other storage containers. Historically, spills or releases have often occurred from underground storage tanks, dry cleaners and other commercial and industrial facilities. By taking appropriate Preventive and Readiness steps, the potential of spills and releases is reduced.
INVESTIGATE POTENTIAL ENVIRONMENTAL CONCERNS "Call Us Before You Buy" Investigate unknown environmental conditions before buying, leasing, financing, developing, refinancing real property or entering into any agreement in which you take an interest in real property, including holding real property as collateral. aec recommends conducting a Phase I Environmental Site Assessment (ESA) before taking an interest in or financing real estate transactions. A Phase I ESA is recommended for most commercial, industrial, multifamily, undeveloped and many other type(s) of properties. Certain properties known or suspected to have a release or a high potential for environmental concerns may be recommended to conduct a Phase II ESA.
RESPOND TIMELY AND APPROPRIATELY TO A RELEASE A commitment to respond timely and appropriately in the event a spill, release or other environmental issue does arise will generally minimize costs and liability. An investigation of a known or suspected release may be conducted on behalf of the property owner or other parties, but is more often conducted in response to, and following applicable rules of the environmental regulatory agency having jurisdiction. Examples include Corrective Action Plan, Site Assessment Report, Compliance Status Report, Environmental Assessment Report. The various federal, state and county environmental agencies often have different names and varying requirements for such reports.
